This course is specifically designed for real estate brokers and salespersons engaged in the practice of rental brokerage. In most cases, a broker’s or salesperson’s license is needed to rent of lease property but there are exceptions which are explained. Discussed also are first, the legal implications of being someone’s “agent” in a real estate transaction as well as the responsibilities of the licensee under the MA Consumer Protection Law (Chapter 93A) to disclose material defects about a property to a prospective tenant./consumer. Additional topics relate to Fair Housing issues, handling of rents and security deposits, the rental/leasing process, lease provisions, the eviction process, and wrongful acts by the landlord. Specifically discussed is the requirement of the licensee to disclose to the prospective tenant the potential for a fee for finding a residence for the tenant.
