Emphasis in this course is placed first on the legal concept of becoming someone’s agent and then the statutory responsibility of the licensee in Rhode Island to disclose to the consumer (buyer or seller) whether, or not, they will be acting as their agent in a real estate transaction. The various types of licensee/consumer relationships allowed in Rhode Island are discussed as well as the responsibilities of the licensee in a non-agency (customer only) relationship. The second part of the course discusses having a buyer as a client; the contractual necessities to create an obligation for a commission, various commission compensation methods, the possibility of becoming a dual agent, and the statutory disclosure requirements if a dual agency occurs. The remainder of the course is devoted to exploring some other legal issues affecting the Buyer Agent and their client, the buyer, such as the State and Federal Lead Paint Statute, the State’s Home Inspector Law, the Stigmatized Property Act, the Sex Offender Registry, and the State’s Consumer Protection Law.
